12. Third‑Party Services and Links

Our Services may link to or integrate with third‑party tools (e.g., payment processors, registration systems, video platforms, social media). Those providers are responsible for their own terms and policies. We are not responsible for their content, practices, or security.

13. Disclaimer of Warranties

The Services are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

14. Limitation of Liability

To the maximum extent permitted by law:

Stampede and its officers, directors, employees, and volunteers will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services or participation in programs.

Our total liability to you for any claim related to the Services will not exceed the greater of:

Some jurisdictions do not allow certain limitations; in those cases, we will apply the limitations to the fullest extent permitted.

15. Indemnification

You agree to indemnify and hold harmless Stampede and its officers, directors, employees, and volunteers from and against claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of:

Your violation of these Terms.

Your misuse of the Services.

Your violation of any rights of a third party.

This does not apply to claims arising solely from Stampede’s gross negligence, willful misconduct, or violations of law, to the extent such limitations are not allowed.

These Terms are governed by the laws of the District of Columbia, without regard to conflict‑of‑law rules.

Subject to the arbitration agreement below, any dispute that proceeds in court will be brought in the state or federal courts located in the District of Columbia.

17. Dispute Resolution and Arbitration

We prefer to resolve issues through clear communication and problem‑solving.

Informal resolution

Before filing arbitration or legal action, you agree to email legal@stampedelacrosse.org with a description of your concern and allow 30 days for us to attempt resolution.

Arbitration

If we cannot resolve the dispute informally, any dispute or claim arising out of or relating to these Terms or the Services (except for requests for injunctive relief or intellectual property disputes) will be resolved by binding arbitration on an individual basis.

Arbitration will be conducted by a recognized arbitration provider under its rules and may occur in Washington, DC or via video conference.

Each party will bear its own costs and attorneys’ fees, except Stampede will reimburse your arbitration filing fee up to $250 unless the arbitrator finds your claims are frivolous.

No class actions

You agree not to bring claims as a plaintiff or class member in any class, collective, or representative action.

Exceptions

Either party may seek injunctive or other equitable relief in court for intellectual property issues or unauthorized access or misuse of the Services.

18. Force Majeure

Stampede is not liable for delays or failures to perform obligations when caused by events beyond our reasonable control, including natural disasters, public health emergencies, government orders, facility closures, severe weather, or similar events.

If a program is significantly disrupted by such an event, we will make reasonable efforts to reschedule, provide alternative programming, or offer credits or refunds consistent with our Refund Policy.
